2010 NAR REALTOR® Party Video Contest Rules
1. Disclosure; Contest Period
No donation, purchase, or obligation of any kind is necessary to win. A donation or purchase will not increase your chances of winning. The 2010 NAR REALTOR® Party Video Contest (Contest) is sponsored by the National Association of REALTORS® (Sponsor). Entries will be accepted between August 9, 2010, and October 16, 2010.
2. Eligibility
Void where prohibited by law. The Contest is subject to all applicable federal, state, and local laws and regulations in the United States. Employees and independent contractors of Sponsor, and any other individual or entity involved in the development, promotion, or execution of the Contest, and the immediate family members and/or household members of each are not eligible.
3. To Enter
Enter by submitting a video response to the REALTOR® Action Center Call for Entries video on YouTube at [link to come] and by completing all parts of the Official Entry Form online at http://www.realtoractioncenter.com/video/2010-video-form.html. Video submissions must share a story about how the REALTOR® Party has helped with a REALTOR® or REALTORS® clients, community or business. Entries must contain your first name, last name, association name, city, state, e-mail address and a contact phone number. You must also identify all individuals who appear in the video. You may submit more than one video, but must complete an Official Entry Form for each video submitted. Submission of a video constitutes your representation and warranty that all sounds, words, text, images, music, or other material included is original or in the public domain, has not been published, broadcast, or otherwise publicly distributed previously, and does not infringe and is not subject to any claim that it violates the intellectual property or other rights of any third-party. Entry of a video constitutes your certification that you are (i) the owner of the video, (ii) able and authorized to submit it, and (iii) have received the consent of anyone pictured.
4. Winning Contestants; Prizes
A panel of judges will review entries and select Winners based on originality, expression, and video content. All decisions of the panel are final. One Winner will be awarded one (1) $500 American Express Gift Card. Two runners-up will each receive one (1) $250 American Express Gift Card.
5. Winner Notification/Prize Claims
Winners will be selected on or about October 22, 2010, and will be notified on or about November 6, 2010. In the event that a Winner is unable or unwilling to accept a Prize, an alternate Winner will be selected. Prior to delivery of any Prize, winners will be required to complete and sign an Affidavit of Eligibility and Liability Release, and, where legal, a Publicity Release, all of which must be returned within 30 days of attempted prize notification or the Prize will be forfeited and awarded to an alternate winner. Sponsor may also require that any person(s) shown in the video also execute a release or other confirmation of consent to such appearance in, and display or distribution of, the video. If the Prize is won by an eligible person who is not of legal age in the state of residence, the prize shall be awarded in the name of the Winner's parent or legal guardian, who must sign and return all required documentation prior to receiving the Prize. In the event of noncompliance with these Rules, or if a Prize or prize notification is unclaimed or returned as undeliverable, the Prize will be forfeited and may be awarded to an alternate winner.
6. Prize Restrictions
Prizes are not transferable. No substitution of Prizes is permitted except at the sole discretion of Sponsor. Any federal, state, or local taxes on Prizes and any expenses related to the acceptance and/or use of the Prizes not specified herein as being awarded are the responsibility of the Winners.
7. Authorization and Release
By submitting your video, you consent to Sponsor’s use or non-use of the video, and of your name, likeness, voice, and/or biographical information for promotional and othe purposes without additional compensation, except where prohibited by law. You also give Sponsor an exclusive, irrevocable license to use, publish, edit, adapt, and/or modify your video in any way and in any and all media now known of hereafter invented worldwide, without limitation or compensation to you. Sponsor may use or not use your video submission in its sole discretion and judgment. Winning does not in any way guarantee Sponsor’s use of the video submission. By submitting your video, you agree to release, and to indemnify, save and hold harmless, Sponsor and its members, officers, directors, employees, independent contractors, representatives, affiliates, and agents from and against any claim or cause of action arising out of participation in the Contest, Sponsor's use, distribution, and display of the video as described in these Contest Rules, or the receipt, redemption, or use of any prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession or awarding of any prize.
8. Limitation of Liability
Sponsor is not responsible for printing, typographical, human, or other errors of any kind in any contest-related materials or for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries. Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Contest without further obligation. In such an event, Sponsor may, but shall have no obligation, to award a Prize from among all valid and eligible entries received prior to such action. The Contest is governed by laws of the State of Illinois for the resolution of all claims and disputes (excluding any claims against or disputes involving parties other than NAR relating to any prize awarded in the contest).
9. List of Winners
To receive a list of the Winners, send a stamped, self-addressed envelope to "2010 REALTOR® Party Video Contest," National Association of REALTORS®, 500 New Jersey Avenue NW, Washington, DC 20001. Requests must be received by December 31, 2010. The Winners' names will be sent when all of the entries have been judged and the winner has been verified.
